1. Who provides Nagomi

Nagomi ("the app") is developed and provided by an independent developer based in Osaka, Japan ("we", "us"). You can reach us at support@nagomi.day, and we answer every message ourselves.

By downloading or using the app you agree to these Terms of Use. If you do not agree, do not use the app.

2. Your licence

We grant you a personal, non-transferable, non-exclusive licence to use Nagomi on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, sublicense, redistribute, reverse-engineer, or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it despite this restriction.

These Terms are the licence agreement for Nagomi and take the place of Apple's standard Licensed Application End User Licence Agreement. Your separate relationship with Apple is still governed by the App Store Terms of Service, including its Usage Rules — which is what determines how many of your devices you may install Nagomi on. Section 9 sets out the clauses Apple requires any app-specific licence to contain.

3. Purchases and subscriptions

Nagomi has a free plan that does not expire. Some features require Nagomi Pro, which is available as an auto-renewing subscription or as a one-time purchase.

• All payments are handled by Apple. We never see or process your payment details. Purchases are charged to your Apple Account.
• Prices are shown in the app before you buy, in your local currency, and they vary by region. The price shown at the moment of purchase is the price that applies.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• A free trial, where offered, converts into a paid subscription unless you cancel at least 24 hours before it ends. If you buy a subscription while a free trial is running, the unused part of the trial is forfeited.
• You manage and cancel subscriptions in your Apple Account settings, not in Nagomi. Deleting the app does not cancel a subscription.
• A one-time purchase does not renew and is not a subscription.
• Refunds are handled by Apple under the App Store's own policies. We cannot issue refunds ourselves, though we are happy to help you work out what went wrong.

If a subscription lapses, Pro features stop being enforced. Nagomi will tell you this plainly rather than silently doing less than you expect. Your schedules are not deleted.

4. What Nagomi does, and what it does not

This section matters more than the rest, so it is written plainly rather than defensively.

Nagomi uses Apple's Screen Time frameworks (Family Controls, Device Activity and Managed Settings) to apply the system's own app shields on a schedule you define. It works within those frameworks and inherits their behaviour and their limits.

• Nagomi is friction, not enforcement. Anyone holding the device can turn off Screen Time access for Nagomi in iOS Settings, or delete the app, and every block stops immediately. Strict Mode delays some changes made inside Nagomi; it does not and cannot prevent this. We will never describe it as unbreakable, and you should not rely on it as though it were.
• It is not a parental control or supervision product. Nagomi asks for individual Screen Time authorisation, which means it manages the device it is installed on, for the person using it.
• Scheduling depends on iOS. Blocking is triggered by the operating system at the times you set. Timing is normally accurate to within a minute or two, but it is not under our control, and a system-level failure, an OS update, or a revoked permission can prevent a boundary from firing.
• Apple imposes limits we cannot remove. There is a system cap on how many schedules an app may register at once, and on how many individual apps can be shielded simultaneously. Nagomi shows you where you stand against these limits rather than failing quietly, but it cannot raise them.
• Some apps cannot be blocked. iOS does not allow Settings or Phone to be selected, for safety reasons. This is Apple's decision, not ours.

Nagomi's reliability reporting exists precisely because these things can go wrong. It is designed to tell you when the app is not protecting you. It is not a guarantee that it always will.

5. Your responsibilities

You are responsible for the schedules you create and for any consequences of apps being blocked or unblocked. Do not use Nagomi in a way that could put you or anyone else at risk — for example, do not rely on it in a situation where being unable to open an app quickly would be dangerous. Emergency calling is not affected by Nagomi, and the Phone app cannot be blocked.

6. Availability and changes to the app

We may add, change, or remove features, and we may stop distributing or supporting the app entirely. Where a change would remove something you have paid for, we will say so in advance through the app or this site, so far as we reasonably can.

7. No warranty

Nagomi is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that every scheduled block will apply as intended.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any right you have under mandatory consumer protection law.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, time, or opportunity, arising out of your use of or inability to use Nagomi — including any case where a block did not apply, applied when you did not expect it, or was bypassed.

To the fullest extent permitted by law, our total liability to you for all claims relating to the app is limited to the amount you actually paid for it in the twelve months before the claim arose.

Nothing in these Terms excludes liability for fraud, or for anything that cannot lawfully be excluded.

9. Apple

Apple requires every app-specific licence agreement to contain the clauses below. They are set out in full rather than referenced, so that this page stands on its own.

• This agreement is between you and us, not Apple. Apple is not a party to it and is not responsible for Nagomi or its content.
• Support is ours. We are solely responsible for any maintenance and support for Nagomi. Apple has no obligation to provide either.
• Warranty. We are solely responsible for any warranties that are not effectively disclaimed in section 7. If Nagomi fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind in relation to Nagomi.
• Claims. We, not Apple, are responsible for addressing any claim relating to Nagomi, including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
• Intellectual property. If a third party claims that Nagomi infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• Where you are. By using Nagomi you confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. The Osaka District Court is agreed as the court of first instance for any dispute arising from them. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, nor of any right you have to bring proceedings in your own local courts.

11. Changes to these Terms

We may update these Terms. The date at the top of this page always reflects the current version. If a change materially reduces your rights, we will make it visible in the app rather than only here. Continuing to use Nagomi after a change means you accept it.
